NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCAHSE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
- ELIGIBILITY
Soft Pretzel Franchise Systems, Inc.’s (“dba Philly Pretzel Factory”), Scratch & Win Promotion (“Promotion”) is open to all legal residents in the (50) United States. Employees of SPFS, Inc. and other companies associated with this Promotion, and their respective parents, subsidiaries, affiliates, and advertising and promotion agencies as well as the immediate family, (spouse, parents, siblings, and children) and household members of each such employee are not eligible. This Promotion is subject to federal, state, and local laws and regulations.
- ADMINISTRATOR
This Promotion is administered by: SPFS Inc.; located at 1525 Ford Road, Bensalem, PA 19020.
- AGREEMENT TO OFFICIAL RULES
Participation in the Promotion constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Administrator which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.
- PROMOTION PERIOD
The Promotion begins on April 21, 2019 at 6:00AM EDT and ends on May 31, 2019 at 7:00PM EDT or while supplies of the Scratch & Win Cards last; whichever occurs first. (“Promotion Period”). All Scratch & Win Cards must be received during the period stated for the Promotion Period. Cards that are submitted before or after the Promotion Period will be disqualified. Administrator reserves the right to extend or shorten the contest at their sole discretion.
- HOW TO ENTER
During the Promotion Philly Pretzel Factory will give cards to individuals who visit participating Philly Pretzel Factory locations. When an Individual (“Entrant”) receives a Scratch & Win Card the Entrant at some time after must scratch all of the silver indicated game-play areas to participate/play. In order to win a prize, Entrants must match (3) like symbols in a row to win the prize shown in the scratched area labeled prize area on each card. Limit (1) card per person per day. Full lists of prizes as well as details on how to claim a prize are shown in these Official Rules. All entries become the property of the Administrator and will not be acknowledged or returned.All Entrants are additionally eligible to win additional prized on the on-line game. This is done by scratching off the silver indicated game-play area to reveal a code, which then must be entered along with additional requested information by the Entrants. The winner of the Tropical Vacation will be determined by code, and if no one claims that code, a live drawing will be held on June 3, 2019; place and time to be at Administrator’s discretion. Philly Pretzel Gift Card winners will be determined by code. If no one claims any of those winning codes those prizes will not be awarded.By providing any information you agree that Soft Pretzel Franchise Systems Inc. has the right to use submitted contact information and name for future offers and promotions. Soft Pretzel Franchise Systems Inc. will not sell or rent any of your information to 3rd party vendors.
Soft Pretzel Franchise Systems Inc. reserves the right to substitute any prize with a prize of equal or greater value due to availability.
- PRIZE DESCRIPTION
There are approximately 900,000 game cards printed. Prizes available to be won are as follows:One (1) 5-night tropical getaway vacation to a Dreams Resort as well as round-trip coach airfare for two people (or $4000 cash option) is available to win. Soft Pretzel Franchise Systems reserves the right to substitute the trip for that of equal or greater value prizes due to availability.One (1) patio prize pack consisting of a market umbrella, JBL Bluetooth splash-proof speaker, grill, cooler and two Adirondack chairs with a value of $1050. Soft Pretzel Franchise Systems reserves the right to substitute the brand or any elements of the prize for that of equal or greater value prizes due to availability.
Five (5) Pure Leaf summer prize pack consisting of a cooler, Bluetooth speaker, and hat with a value of $180 each. Soft Pretzel Franchise Systems reserves the right to substitute elements of the prize for that of equal or greater value prizes due to availability.
Ten (10) Philly Pretzel Factory summer prize pack consisting of gift certificates, a backpack, a beach towel, water bottle and hard pretzels valued at $125 each. Soft Pretzel Franchise Systems reserves the right to substitute elements of the prize for that of equal or greater value prizes due to availability.
Twelve (12) per store will be awarded one Free Pure Leaf Herbal Tea (Hibiscus flavor). Soft Pretzel Franchise Systems and our local franchisees reserve the right to substitute in-store food or beverage products for that of equal or greater value prizes due to availability.
Twenty Five per store (25 per store) BOGO Pretzel Dog and twenty five per store (25 per store) BOGO Rivet Shaker. Soft Pretzel Franchise Systems and our local franchisees reserve the right to substitute in-store food products for that of equal or greater value prizes due to availability.
Two Hundred (200) per store will win a Free Pretzel. Soft Pretzel Franchise Systems reserves the right to substitute PPF cards for that of equal or greater value prizes due to availability.
Four Hundred (400) per store will win a Free Small Dip. Soft Pretzel Franchise Systems reserves the right to substitute PPF cards for that of equal or greater value prizes due to availability.
Five Hundred (500) Philly Pretzel Factory $10 Gift Cards are available to win. Soft Pretzel Franchise Systems reserves the right to substitute PPF cards for that of equal or greater value prizes due to availability.
Six Hundred (600) per store $3 Off Any Pretzel Party Tray coupons will be awarded. Soft Pretzel Franchise Systems reserves the right to substitute coupons for that of equal or greater value prizes due to availability.
One Thousand (1000) $5 Philly Pretzel Factory gift cards will be awarded through on-line methods to players who enter a prize-winning code from their game card and all other requested information. Soft Pretzel Franchise Systems reserves the right to substitute PPF cards for that of equal or greater value prizes due to availability.
Philly Pretzel Factory Scratch &Win Card giveaways & coupon offers are available to win. Coupons and offers may be redeemed upon the winner’s next store visit. Game Card redemptions are not to be combined with other offers. (1) Card per customer is permitted per day. Game cards are not redeemable during the store visit in which winning game card is issued.
ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE SOLELY THE RESPONSIBILITY OF ALL WINNERS.
- PRIZE RESTRICTIONS
All Prizes must be taken as offered and cannot be sold or traded, substituted, redeemed or exchanged for cash, credit or alternative prizes, except in the Administrator’s sole discretion. Administrator reserves the right to substitute a Prize with a prize of equal or greater value. No credit or reimbursement will be provided if a Prize is not taken. Prizes cannot be combined with any other promotional offer or offers provided by Soft Pretzel Franchise Systems, Inc.
Other restrictions may apply.
- HOW TO CLAIM A PRIZE
Entrants with winning Scratch & Win Prize Cards with edible prizes must claim their prize by exchanging their game card for the selected item at any participating Philly Pretzel Factory location. Prior to exchanging the game card, entrants must fill out their name and contact info on the reverse side of the scratch card. Entrants with winning Premium Prize Cards including Grand Prize winners must call 800-679-4221 to claim their prize.
Upon being contacted by the Administrator, Winners of Premium Prizes are required to fill out a “prize winning form”, which will be e-mailed from Soft Pretzel Franchise Systems, Inc. After filling this form out Winners must mail the “prize winning form” along with winning game card to Soft Pretzel Franchise Systems Inc. at 1525 Ford Road, Bensalem, PA 19020.
Please note on the mailing envelope: “Attention Scratch & Win Prize Committee.” If the above steps of prize claiming are not followed, Soft Pretzel Franchise Systems reserves the right to not fulfill the prize won on selected game card(s).
- ADDITIONAL LIMITATIONS
Prizes are non-transferable. Administrator and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of this Promotion, including, but not limited to, errors in any printing or posting of these Official Rules, the selection and announcement of any winner, or the distribution of the premium prizes. Any attempt to damage the content or operation of this Promotion is unlawful and subject to possible legal action by Administrator. Administrator reserves the right to terminate, suspend or amend this Promotion, without notice, and for any reason, including, without limitation, if Administrator determines that this Promotion cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Administrator’s control corrupt the administration, security, fairness, integrity or proper play of this Promotion.
- PRIVACY
Information collected from entrants is subject to Administrators privacy policy.
- PUBLICITY
By participating, each entrant grants Administrator permission to use his/her name, likeness or comments for publicity purposes without payment of additional consideration, except where prohibited by law. Administrator may also use or disclose your personal information for any other purposes for which you have provided your consent.
- DISPUTES
Except where prohibited, each Entrant agrees that any and all disputes, claims, and cause of actions arising out of, or connected with this Promotion; or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the state of Pennsylvania. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrants rights, and obligations of the Administrator in connection with this Promotion, shall be governed by, and construed in accordance with the laws of Pennsylvania without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Pennsylvania.

- INDEMNIFICATION AND LIMITATION OF LIABILITY
BY ENTERING THE PROMOTION, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS ADMINISTRATOR AND ITS AFFILIATES AND ANY SUBSIDIARY COMPANIES, ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THIS PROMOTION AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. ADMINISTRATOR AND ITS AFFILIATES AND ANY SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE. ADMINISTRATOR AND ITS SUBSIDIARIES, AFFILIATES, ADVERTISING AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THIS PROMOTION.
